Clarification of Minor Prior Year Charges

ED recently issued DCL GEN-09-11 to clarify Minor Prior Year Charges for institutions. On Nov. 1, 2007, ED published final regulations modifying provisions that allow institutions to use current year Title IV funds to pay for minor prior year charges, increasing the maximum amount from $100 to $200.

This DCL clarifies issues that have been raised regarding:

• compliance with those regulations, such as how to determine current versus prior year charges;
• cost of attendance, with respect to the prior year charges; and
• return of Title IV funds, with respect to leaving outstanding charges in the prior year.
